By using Dropoint's platform, mobile application, or website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. Your continued use of our services constitutes your acceptance of any updates or modifications to these terms.

2. Description of Service

Dropoint provides same-day delivery, errand running, and business logistics services in Nairobi and surrounding areas. Our services include residential deliveries, business deliveries, errand services, and courier solutions. Service availability is subject to geographic area coverage and operational capacity.

3. User Eligibility

To use Dropoint services, you must:

• Be at least 18 years of age
• Have a valid email address and phone number
• Provide accurate and truthful information during registration
• Have the legal capacity to enter into binding agreements
• Comply with all applicable local, national, and international laws

4. User Accounts & Responsibility

Account Creation: You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.

Account Termination: Dropoint reserves the right to terminate any account that violates these terms or engages in fraudulent, illegal, or harmful activity.

5. Acceptable Use Policy

You agree NOT to use Dropoint services for:

• Illegal activities or violation of any laws
• Harassment, abuse, or harm to any person
• Delivery of prohibited, dangerous, or illegal items
• Fraud, deception, or misrepresentation
• Sending spam, malware, or malicious code
• Violating intellectual property rights
• Disrupting or interfering with Dropoint's services

6. Prohibited Items

Dropoint cannot deliver the following items:

• Illegal drugs, firearms, or explosives
• Hazardous materials or toxic substances
• Live animals (except service animals as per regulation)
• Items that are counterfeit or stolen
• Perishable goods without proper insulation and ice packs
• Large furniture requiring special handling
• Items exceeding weight or size limits

7. Payment Terms

• Full Payment Required: Payment must be made in full before or at the time of service delivery
• Accepted Methods: Mobile money (M-Pesa), credit/debit cards, bank transfer, cash on delivery (where available)
• Price Accuracy: All prices are in Kenya Shilling (KES) and include applicable taxes unless otherwise stated
• No Refunds for Non-Cancellations: Orders completed as requested are not refundable

9. Limitation of Liability

AS-IS SERVICE: Dropoint's services are provided on an "AS-IS" and "AS-AVAILABLE" basis. We make no warranties or representations, express or implied, regarding the quality, reliability, or fitness of our services.

LIABILITY CAP: Dropoint's liability is limited to the total amount paid for the specific order in question. Dropoint is not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business
• Delays caused by weather, traffic, or external factors
• Acts of God or force majeure events

10. Intellectual Property Rights

All content on Dropoint's website, including text, graphics, logos, images, and software, is the property of Dropoint or its content suppliers and is protected by copyright laws. You may not reproduce, distribute, or transmit any content without prior written permission from Dropoint.

11. Privacy & Data Protection

Your use of Dropoint services is governed by our Privacy Policy. Please review it to understand our data collection and usage practices.

12. Third-Party Links & Content

Dropoint's website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites. Your use of third-party sites is at your own risk and governed by their terms and conditions.

You agree to indemnify and hold harmless Dropoint, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of Dropoint services or violation of these terms.

Dropoint reserves the right to modify these Terms of Use at any time. Significant changes will be notified via email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

15. Governing Law & Jurisdiction

These Terms of Use are governed by the laws of Kenya. Any disputes arising from your use of Dropoint services shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.

16. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
